Terms & Conditions

The information provided below are the terms of my services. If a contract or external agreement is signed by all parties that contradicts the content of these terms, the signed contract or agreement shall become binding and the contradicting terms listed below shall become null.


Terms and Conditions are subject to change. Please refer to your agreement for final terms.

Payments

A $100 retainer fee will be due upon booking. The remaining amount is due 30 days prior to your event unless payment arrangements are otherwise agreed upon by all parties in writing. We accept payments via cash, check*, PayPal, and Cash App. Checks should be made to DTURN Studios.

 

*additional fees may be charged for bounced checks.

Please note that we do not secure your date on our calendar until the retainer is received. If full payment is not received by the event date and alternative arrangements have not been made, we retain the right to decline services and the retainer will be forfeited.

Rescheduling, Cancellations, and Refunds

RESCHEDULING

Any event or shoot rescheduling is subject to the availability of the photographer/booth availability. If the event or photoshoot is rescheduled, it must be within 12 months of the original event date to avoid the cancellation policy going into effect. Additional fees for travel, design, and or accommodations may apply.

CANCELLATIONS

If the event or photoshoot is canceled within the cancellation period for any reason, a full refund of any amount paid up to that point will be issued to the purchaser. If an event or services are canceled beyond the cancellation period, and it is not at the fault of DTURN Studios or an uncontrollable circumstance, the purchaser forfeits their retainer. If the remaining amount has been paid, the purchaser will receive a refund for the amount paid minus their retainer unless otherwise approved in writing, at the full discretion of DTURN Studios.

Digital Sharing

Digital image and video sharing relies on stable wireless connections that are not within our full control in certain locations/venues.

  • If an internet connection can not be established, we will continue sessions and photos and videos will be shared once the connection is secure and/or within 24-48 hours of event.

  • If a camera connection can not be established, we will resume operations via alternative capture devices.

Certificate of Liability Insurance

DTURN Studios is fully insured and can provide a certificate of liability insurance upon request. To ensure you receive this prior to your event, I ask that you request this at least 1-2 weeks prior to your event. We are insured up to one million dollars for each occurrence and two million aggregate.

Release Statement

We understand that some clients may want the photos from their event to remain private. Therefore, you have the option to decline the release. If you choose to decline the release, please state in writing via email or in the agreement. Otherwise, Client agrees to, and understands the following: All guests using our services hereby give to DTURN Studios: The right and permission to copyright and use, photographic portraits or pictures of any photo booth user who may be included intact or in part, made through any and all media now or hereafter known for illustration, art, promotion, advertising, trade, or any other purpose. Furthermore, we reserve the right to take photos or videos throughout the event for marketing & promotional purposes.

Dispute Resolutions

If any provision of these terms shall be unlawful, void, or for any reason unenforceable under Contract Law, then that provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforceability of any remaining provisions, or portions thereof. This is the entire agreement between DTURN Studios and the client relating to the subject matter herein and shall not be modified except in writing, signed by both parties. In the event of a conflict between parties, the client agrees to mediate in good faith amongst parties or via arbitration.
